What We Like: Cabrillo’s faculty CBA offers binding arbitration instead of advisory arbitration. Binding arbitration is arguably the better model for settling disputes, as it ensures that the final decision between two parties is made by an independent third party. Districts that use advisory arbitration rely on the Board of Trustees to make the final judgements. Because of the Board’s involvement in district affairs and their relationships, histories, etc. with employees or employee groups at the institution, this may create conflicts of interest (or the appearance of one).
